Terms of Use

1. Accepting these terms

By creating an account or using Zelus Fitness, you agree to these terms and our Privacy Policy. You must be at least 18 years old and legally able to enter this agreement.

2. Fitness and health notice

Zelus Fitness provides general fitness, nutrition and wellness information. It is not medical advice, diagnosis or treatment and does not replace care from a qualified health professional.

Before starting a new program, seek professional advice if you are pregnant, post-partum, injured, unwell, have a medical condition or are unsure whether exercise is suitable. Stop immediately and seek help if you experience pain, dizziness, chest pain, unusual shortness of breath or other concerning symptoms. You are responsible for choosing safe weights, technique, space and equipment.

3. Accounts

Provide accurate information, keep your password secure and do not share your account. Tell us promptly if you suspect unauthorised access. We may suspend or close accounts used fraudulently, unlawfully or in breach of these terms.

4. Memberships, trials and cancellation

If paid memberships are offered, the price, billing period, free-trial terms and renewal details shown at checkout form part of these terms. Unless you cancel before the trial or current billing period ends, your chosen membership may renew automatically and the payment method on file may be charged.

You may cancel a recurring membership before its next renewal. Cancellation stops future renewals and access ordinarily continues until the end of the paid period. Refunds and remedies are provided where required by the Australian Consumer Law; nothing in these terms excludes rights that cannot lawfully be excluded.

5. Your content

You retain ownership of photos and information you add. You give us permission to process that content only as needed to operate and display the features you use. You must have the right to upload anything you submit and must not upload unlawful, harmful or infringing content.

6. Zelus content and acceptable use

Programs, videos, meal ideas, branding, text, graphics and other Zelus content are owned by or licensed to Zelus Fitness. Your membership gives you a personal, limited, non-transferable right to use them. You must not copy, resell, redistribute, record, scrape, reverse engineer or commercially exploit the service, or interfere with its security or operation.

7. Availability and changes

We may update programs, features, prices and these terms, and may pause the service for maintenance or circumstances beyond our control. We will provide reasonable notice of material changes where practical.

8. Liability

To the extent permitted by law, you use fitness activities at your own risk. We do not promise a particular fitness, weight or health result. Our liability is not limited where doing so would be unlawful, including rights and guarantees under the Australian Consumer Law.

9. Ending access

You may stop using Zelus Fitness at any time. We may suspend or terminate access for a serious or repeated breach, unlawful conduct, non-payment or a security risk. Terms that by their nature continue after termination remain in effect.
